Eight dead crash driver may never stand trial

Accused described as ‘unfit to be tried’

The Inishowen man accused of dangerous driving causing the deaths of eight people in the worst car crash in the history of the State may never face trial.

Relying on comprehensive medical reports, Shaun Kelly’s legal team this week claimed that he is unfit to stand trial and if the judge accepts that assessment then the case is likely not to come before court.

The trial had been due to start next Tuesday, February 4 but could now be subject to endless delays as both sides dispute the 24-year-old’s mental capacity to plead to the serious charge against him.

Senior doctors, commissioned by the defence, have been assessing Mr. Kelly’s condition over the past number of years and now firmly believe that he is unable to stand trial.
